Paris Hilton: In Hallmark fight
A federal appeals court has ruled on Monday that Paris Hilton can pursue her lawsuit against Hallmark Cards Inc. over its use of her picture and catchphrase "That's hot" on a greeting card.
The celebrity and heiress Paris Hilton sued the company in 2007 after finding they have violated her privacy and right of publicity by ripping off a scene from her reality TV show "The Simple Life" on a birthday card captioned "Paris's First Day as a Waitress". A photo of Hilton's face was pasted on the cartoon's body.
On Monday, a three judge panel of the 9th U.S. District Court of Appeals rejected Hallmark's argument that its depiction of the Hilton Hotels heiress was protected speech as a matter of law.
They sent the case back to a lower court again which has already turned aside Hilton's claim of trademark infringement but rejected other Hallmark defenses.
